660.15 SNOW
REMOVAL
(a) No person, company, contractor, or private
snow removal company or entity while in the process of snow plowing or
removal shall deposit or cause to be deposited any snow and/or ice that
would obstruct, hinder, block or cause injury to any public or private
road, sidewalk, driveway, fire hydrant, or to the landscaping of any
property. All snow from any premises shall be deposited onto the same
premises from which it was moved, plowed or removed. City or State snow
plow operations are exempt from this section.
The city shall not be responsible for any damage to mailboxes, garbage
cans, landscaping or other objects located within the city right of way
during the course of snow plowing operation.
(b) This section shall apply to
damage caused by the accumulation of snow as well as damage caused by
personnel or plowing equipment.
(c) Nothing in this section shall relieve property owners or
commercial snow plowing companies from compliance with Section 412.01 or
660.05 of these Codified Ordinances.
(d) Whoever violates this section is guilty of a minor
misdemeanor. A separate offense shall be deemed committed each day
during or on which a violation occurs or continues. The penalty shall be
as provided in Section 698.02.
CHAPTER
834 REGISTRATION OF SNOW PLOW OPERATORS
834.01 REGISTRATION PROCEDURE.
The Building Commissioner shall
register and issue sticker registration tags to all applicants who:
(a) Complete an application form
prescribed by the Building Commissioner for the registration of private
snow removal companies and/or persons providing fee-based snow removal services in
the City;
(b) Pay an annual registration
fee as set forth in Chapter 214 for each vehicle for which sticker
registration tags are to be issued;
Registration fee: $10.00 per vehicle per year
(c) Demonstrate proof of
liability insurance.
834.02 DISPLAY OF TAGS.
All private snow removal companies,
persons, firms or individuals providing fee-based snow removal services shall prominently display, on each vehicle
used in snow removal or plowing, a current registration tag, issued by
the Building Commissioner, at all times while such vehicle is engaged in
removal, pushing or plowing of snow on private property within the City.
834.03 MISCELLANEOUS.
Each vehicle shall be equipped with
a yellow flashing light which shall be turned on and active at all times
during snow removal operation.
834.99 PENALTY.
Whoever violates or fails to comply
with any of the provisions of this chapter is guilty of a minor
misdemeanor and shall be sentenced in accordance with Section 698.02.
